What is the HathiTrust and What Is It Doing?

Last year, the Authors Guild brought suit against the HathiTrust and several of its library members over the collection of digitized books that Hathi and it’s partners hold as a result of the Google Books project. In addition to the existence of the Google scans, the Authors Guild raised concerns about a pilot program involving “orphan works.”

For libraries watching this suit, it is very important to answer some key questions: what is the HathiTrust and what is it doing? What are its legal arguments? What are the prospects for the case against it?
